What is a patent and how do you get one?

A patent protects a person or a business’s idea or product. Once you have a patent, it gives the owner the legal right to exclude others from making, using, or selling the idea or product for a fixed period. A patent is typically good for 20 years from when the application was submitted.

Getting a patent is a complex process. First, you need to make sure your idea is patentable; this means that your idea must be fully developed. Then you must do a search to make sure that there is not already a patent for your idea/product. Then you must file your application to the United States Patent and Trademark Office (USPTO)

The process of obtaining a patent includes:

  1. Conducting a prior art search: To ensure that your invention has not been patented already, this is important to ensure that your product will not infringe upon the rights of another patent holder.
  2. Drafting the patent application: This includes a specification, claims and drawings of the invention.
  3. Filing the patent application: This will secure the earliest filing date possible.
  4. Responding to requests from the USPTO: This could include rejections for a variety of reasons.

Do I need a Patent Attorney?

While you can file for a patent yourself, it is advisable to have an experienced patent attorney represent you for the USPTO. Drafting patent applications requires extensive knowledge of patent law. You could miss vital details about your invention, and how you will be producing it. There is a lot of technical language involved in writing up patents. If any of the information is missed or not written correctly, this can cause your patent to be denied. You need a professional and experienced patent attorney on your side to make sure that nothing is missed, incomplete, or filled out incorrectly.

To be licensed with the USPTO and obtain a patent for their clients, patent lawyers must go through additional training and take the “Patent Bar” to become registered with the United States Patent and Trademark Office. This requires an undergraduate degree in fields such as engineering or science.
